Please read these Terms and Conditions carefully before booking any services with NEWBURY DOG TRAINER.
These Terms and Conditions set out the agreement between you ("the Client", "you" or "your") and NEWBURY DOG TRAINER ("we", "us" or "our") for the provision of dog training and behaviour services.
By making a booking, paying for a service or attending an appointment, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
Nothing in these Terms affects your statutory rights under the laws of England and Wales.
1. Definitions
For the purposes of these Terms and Conditions:
Agreement means the contract between NEWBURY DOG TRAINER and the Client.
Behaviour Consultation means an appointment focusing on behavioural concerns, including (but not limited to) fear, anxiety, reactivity, resource guarding, separation-related issues or other behavioural challenges.
Client means the individual purchasing or receiving services from NEWBURY DOG TRAINER.
Dog means the dog or dogs receiving training or behaviour services.
Programme means a package of multiple sessions designed to achieve agreed training or behaviour goals over an approximate period of time.
Services means all training, behaviour consultations, group classes, online support and any associated advice or resources provided by NEWBURY DOG TRAINER.
2. Booking and Formation of Contract
2.1 A booking is confirmed once NEWBURY DOG TRAINER has accepted your booking request and payment has been received (unless otherwise agreed in writing).
2.2 Until payment has been received, appointments or places on courses may be offered to another client without notice.
2.3 By confirming your booking, you confirm that:
you are aged 18 years or over;
you are legally responsible for the dog attending training or have the owner's permission to participate;
all information provided to NEWBURY DOG TRAINER is accurate and complete to the best of your knowledge.
2.4 NEWBURY DOG TRAINER reserves the right to refuse or decline any booking where it reasonably believes the requested service is unsuitable, outside its scope of practice, or where accepting the booking could compromise the safety or welfare of any person or animal.
3. Services
3.1 NEWBURY DOG TRAINER provides professional dog training and behaviour services using evidence-based, ethical and welfare-focused methods.
3.2 Services may include:
one-to-one training;
behaviour consultations;
group training classes;
written training plans;
educational resources; and
follow-up support where included within the purchased service.
3.3 We reserve the right to make reasonable changes to the content or delivery of our services where necessary to:
improve the quality of the service;
reflect current scientific evidence or best practice;
comply with legal or professional requirements; or
respond to circumstances outside our reasonable control.
Any such changes will not materially reduce the overall quality of the service purchased.
4. Positive Reinforcement Policy
4.1 NEWBURY DOG TRAINER is committed to force-free, reward-based training in accordance with the ethical principles of the Institute of Modern Dog Trainers (IMDT) and current evidence-based practice.
4.2 All training recommendations are designed to minimise stress, protect welfare and encourage learning through positive reinforcement.
4.3 Clients agree to make every reasonable effort to follow the training methods recommended during the course of their programme.
4.4 During the period in which services are being provided, clients must not intentionally use equipment or methods designed to cause pain, fear, intimidation or unnecessary discomfort.
Examples include, but are not limited to:
prong collars;
electronic collars (e-collars), spray collars, vibrating collars;
choke chains;
physical punishment;
leash corrections intended to cause discomfort;
intimidation or deliberate frightening of the dog.
4.5 Where NEWBURY DOG TRAINER reasonably believes that aversive training methods are being used in a way that compromises the dog's welfare or prevents ethical continuation of training, we reserve the right to suspend or terminate services in accordance with Section [Termination].
5. Scope of Practice
5.1 NEWBURY DOG TRAINER provides training and behaviour services for pet dogs.
5.2 We are not veterinary surgeons and do not diagnose, prescribe or treat medical conditions.
5.3 Behavioural concerns can sometimes have underlying physical, medical or environmental causes. Where appropriate, we may recommend that you seek further assessment before or during training.
5.4 Referrals may include, but are not limited to:
your veterinary surgeon;
a Clinical Animal Behaviourist;
a Veterinary Behaviourist;
a qualified physiotherapist;
a Dynamic Dog practitioner;
a canine nutrition professional;
a hydrotherapy practitioner;
a pain assessment service; or
another suitably qualified professional whose expertise may benefit your dog's welfare.
5.5 Any discussions regarding health, nutrition, supplements, physical therapies or other complementary services are provided for general educational purposes only and should not be relied upon as veterinary, nutritional or medical advice.
5.6 Where a case falls outside our professional competence, or where we reasonably believe additional expertise would benefit the dog, we reserve the right to recommend or require referral to another appropriately qualified professional before continuing or alongside our services.
5.7 Any recommendation or referral to another professional forms part of our welfare-first approach and does not constitute a failure to provide the contracted services. Such referrals do not, in themselves, entitle the Client to a refund, reduction in fees or cancellation of the Agreement. Any refund that is due will be determined in accordance with the cancellation provisions set out in these Terms and Conditions.
6. Behavioural Outcomes
6.1 Dog training and behaviour modification involve working with living animals whose behaviour is influenced by genetics, health, previous learning experiences, environment, management and consistency of training.
6.2 Whilst NEWBURY DOG TRAINER will exercise reasonable care and skill in providing its services, no guarantee can be given that a particular behavioural outcome will be achieved or that improvement will occur within a specific timescale.
6.3 Success depends upon many factors outside our control, including the consistency with which training recommendations are implemented between appointments.
6.4 Clients acknowledge that meaningful progress requires ongoing participation and agree to practise the recommended training outside scheduled sessions wherever reasonably possible.
6.5 Recommendations provided by NEWBURY DOG TRAINER are based on the information available at the time of the appointment. If relevant information is withheld or later found to be inaccurate, we cannot accept responsibility for any resulting impact on training outcomes.
7. Client Responsibilities
7.1 The Client agrees to provide accurate and complete information about their dog before and throughout the provision of services.
7.2 The Client must inform NEWBURY DOG TRAINER of any material changes that may affect training, including but not limited to:
illness, injury or veterinary treatment;
medication or changes in medication;
behavioural changes;
changes in household circumstances;
changes in the dog's management or routine.
7.3 The Client must disclose, before any appointment or class, whether their dog has:
bitten or injured a person or another animal;
displayed aggressive behaviour towards people or animals;
been subject to any legal restrictions or control notices; or
any other behaviour that could reasonably present a risk to others.
7.4 Failure to disclose relevant information may result in sessions being postponed or terminated. NEWBURY DOG TRAINER accepts no responsibility for any consequences arising from information that was withheld or inaccurately provided.
7.5 The Client acknowledges that dog training and behaviour modification are collaborative processes. Lasting and sustainable progress depends upon the consistent implementation of the recommendations made by NEWBURY DOG TRAINER between appointments.
7.6 Recommendations may form part of a wider training, management and welfare plan and may include, where appropriate:
practical training exercises;
changes to daily management or routine;
environmental modifications;
enrichment and species-appropriate activities;
rest and recovery strategies;
changes to diet or feeding practices;
recommendations to seek veterinary examination or further medical investigation;
referrals to appropriately qualified professionals; and
other reasonable measures intended to support the dog's physical health, emotional wellbeing and learning.
Clients remain responsible for deciding whether to implement these recommendations. However, where recommendations are not followed, or are only partially implemented, NEWBURY DOG TRAINER cannot accept responsibility if this affects the dog's progress, behaviour or training outcomes.
7.7 Where more than one person regularly handles the dog, NEWBURY DOG TRAINER strongly recommends that all handlers follow the agreed training, management and welfare plan to promote consistency.
7.8 The Client agrees not to knowingly place their dog in situations that exceed the dog's current abilities or are inconsistent with the agreed training, management and welfare plan. Where advice provided by NEWBURY DOG TRAINER is not followed, NEWBURY DOG TRAINER cannot accept responsibility for any resulting setbacks, deterioration in behaviour, injury, loss or other consequences arising from those decisions.
7.9 Coordinated Care and Other Training Professionals
7.10 The Client agrees to inform NEWBURY DOG TRAINER if they are currently receiving, or intend to seek, advice or services from another dog trainer, behaviour professional or similar practitioner during the course of their training programme, unless that professional has been recommended or introduced by NEWBURY DOG TRAINER as part of a coordinated approach.
7.11 NEWBURY DOG TRAINER recognises that collaborative working with other suitably qualified professionals can be highly beneficial where it forms part of a planned, welfare-focused programme. However, receiving training or behaviour advice from multiple professionals simultaneously may result in conflicting recommendations, reduced consistency and slower progress.
7.12 Where another professional is involved, the Client agrees to inform NEWBURY DOG TRAINER so that, where appropriate and with the Client's consent, a coordinated approach can be taken in the best interests of the dog.
7.13 If NEWBURY DOG TRAINER reasonably believes that conflicting advice from multiple professionals is preventing the effective, safe or ethical delivery of our services, we reserve the right to discuss this with the Client and, where necessary, suspend or terminate services in accordance with these Terms and Conditions. Any such decision will be made using our professional judgement and with the welfare of the dog as the primary consideration.
8. Dog Health and Welfare
8.1 The Client confirms that, to the best of their knowledge, their dog is fit to participate in training.
8.2 Dogs showing signs of infectious illness, including vomiting, diarrhoea, contagious coughs or other potentially infectious conditions, must not attend appointments or classes.
8.3 If NEWBURY DOG TRAINER reasonably believes a dog is unwell, in pain or otherwise unsuitable to participate safely, the session may be postponed or ended early.
8.4 Where there are reasonable welfare concerns, NEWBURY DOG TRAINER may require veterinary clearance before further services are provided.
8.5 Puppies attending classes should have received appropriate veterinary guidance regarding socialisation and vaccination for their individual circumstances.
8.6 The Client remains responsible for their dog's welfare throughout every appointment.
9. Safety During Training
9.1 The safety of people and dogs is our highest priority.
9.2 Clients agree to follow all reasonable instructions given by NEWBURY DOG TRAINER during appointments and classes.
9.3 Dogs must remain on a lead unless the trainer specifically instructs otherwise.
9.4 Clients must maintain appropriate distance from other dogs unless invited to approach.
9.5 Owners remain legally responsible for their dog's behaviour at all times.
9.6 Any dog waste must be cleared up immediately and disposed of responsibly.
9.7 If a dog is in season, the Client must notify NEWBURY DOG TRAINER before attending. Alternative arrangements may be offered where reasonably practicable.
9.8 NEWBURY DOG TRAINER reserves the right to end or suspend any session where continued participation presents a safety or welfare risk to any person or animal.
9.9 Children attending sessions remain the responsibility of the accompanying adult and must be supervised at all times.
9.10 Vehicles and personal belongings are brought to appointments entirely at the owner's risk.
9.11 Children and Young People
9.12 NEWBURY DOG TRAINER welcomes families to be involved in their dog's training where appropriate. However, due to the complexity of canine learning, behaviour and welfare, all training instruction, behaviour advice and coaching will be delivered to a responsible adult aged 18 years or over.
9.13 Children are welcome to observe or participate in practical exercises where this is appropriate to their age, ability, the individual dog, and the nature of the training being undertaken. Any participation by a child will always be at the discretion of NEWBURY DOG TRAINER and may be limited or withdrawn where necessary to protect the safety or welfare of any person or animal.
9.14 Children are not permitted to have sole control of a dog during training sessions in public places, group classes or any environment where other people, dogs or hazards are present. This includes, but is not limited to, holding the lead, managing the dog or carrying out training exercises independently.
9.15 Any practical activities involving a child will be directly supervised by both the accompanying responsible adult and NEWBURY DOG TRAINER.
9.16 Any person under the age of 18 attending a training session must be accompanied by a responsible adult throughout the entire appointment. This requirement applies to all training environments, including private homes, public spaces, training venues and online sessions where applicable.
9.17 The accompanying adult remains responsible for supervising any child attending the session at all times. NEWBURY DOG TRAINER cannot provide childcare or assume responsibility for supervising children.
9.18 In order to safeguard children and comply with good professional practice, NEWBURY DOG TRAINER communicates only with adult Clients. We do not enter into direct correspondence with persons under the age of 18 by email, telephone, text message, WhatsApp, social media or any other digital communication platform.
9.19 Persons under the age of 18 must not be added to client communication channels, including WhatsApp groups, mailing lists or other digital platforms operated by NEWBURY DOG TRAINER. All communication relating to training services will be conducted with the responsible adult who has entered into the Agreement.
19.20 NEWBURY DOG TRAINER reserves the right to modify or suspend any activity involving a child where, in our professional judgement, continued participation may compromise safety, learning outcomes or the welfare of the dog.
10. Payment
10.1 Prices are displayed in Pounds Sterling (£) and are subject to change without notice. Any price change will not affect bookings that have already been confirmed.
10.2 Payment must be received before services commence unless otherwise agreed in writing.
10.3 Bookings remain provisional until payment has been received.
10.4 Payment may be made by bank transfer, Stripe or any other payment method offered by NEWBURY DOG TRAINER.
10.5 Unless otherwise agreed, all invoice payments are due immediately upon receipt.
10.6 Failure to make payment by the agreed date may result in cancellation of the booking.
11. Training Programmes and Validity
11.1 Training programmes are designed to be completed within the approximate timeframe discussed at the time of booking.
11.2 To maintain continuity of learning and maximise the likelihood of successful outcomes, all sessions within a programme should ordinarily be completed within the agreed programme duration.
11.3 Unless otherwise agreed in writing, Clients will have an additional two-week grace period following the anticipated end of their programme to rearrange and complete any outstanding sessions.
11.4 Any sessions remaining after this period will expire automatically and will not be refunded.
11.5 Extensions may be granted at the sole discretion of NEWBURY DOG TRAINER where exceptional circumstances have prevented completion of the programme.
11.6 Training programmes are personal to the Client and may not be transferred to another individual or another dog without prior written agreement.
12. Cancellation, Rescheduling and Missed Appointments
12.1 Requests to cancel or rearrange appointments must be made in writing by email or text message.
12.2 Where at least 48 hours' notice is provided, appointments may be rearranged without charge, subject to availability.
12.3 Where less than 48 hours' notice is provided, or where the Client fails to attend an appointment, the full session fee will remain payable and the session will be deemed to have been used.
12.4 NEWBURY DOG TRAINER appreciates that emergencies can arise. In genuinely exceptional circumstances, an alternative appointment may be offered at our discretion, but we are under no obligation to do so.
12.5 If the Client arrives late, the appointment will still finish at the scheduled time unless otherwise agreed. This ensures fairness to subsequent clients.
12.6 Where NEWBURY DOG TRAINER is late due to circumstances within our control, the appointment will either be extended where reasonably practicable or rearranged at no additional cost.
12.7 Missed sessions forming part of a programme will not ordinarily be replaced outside the programme validity period.
12.8 Failure to attend two consecutive appointments without prior communication may be treated as abandonment of the programme. In such circumstances, NEWBURY DOG TRAINER reserves the right to close the booking without refund for any unused sessions.
12.9 Nothing in this section affects any statutory rights you may have under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
13. Consumer Cancellation Rights
13.1 If you are purchasing services as a consumer at a distance (for example, online, by email or by telephone), you may have the right to cancel your contract within 14 days of entering into it under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
13.2 If you request that NEWBURY DOG TRAINER begins providing services during this 14-day cancellation period, you expressly request immediate performance of the contract.
13.3 If you cancel after services have begun within the 14-day cancellation period, you must pay for any services already provided up to the date of cancellation.
13.4 Once services have been fully performed, you lose your statutory right to cancel under the Consumer Contracts Regulations.
13.5 Nothing in these Terms affects your statutory consumer rights.
14. Trainer Cancellation and Changes to Services
14.1 NEWBURY DOG TRAINER reserves the right to postpone, rearrange or cancel appointments where reasonably necessary, including but not limited to illness, injury, severe weather, venue issues or other circumstances beyond our reasonable control.
14.2 Where we cancel an appointment, we will offer either:
an alternative appointment; or
a refund for any session that cannot reasonably be rearranged.
14.3 We reserve the right to make reasonable changes to appointment times, venues, instructors or course content where necessary to maintain the quality, safety or delivery of our services.
14.4 Such changes will not materially reduce the value of the services purchased.
15. Weather and Environmental Conditions
15.1 Many appointments take place outdoors in real-world environments, as this forms an important part of effective training and behaviour modification.
15.2 Sessions will normally proceed in typical seasonal weather conditions where it is safe, practical and appropriate to do so.
15.3 The welfare of both dogs and people will always take precedence over maintaining the scheduled appointment.
15.4 Particular consideration will be given during periods of hot weather or official heatwave conditions. Dogs are significantly more susceptible to heat-related illness than humans, and environmental conditions that may appear manageable for people can present an unacceptable welfare risk to dogs.
15.5 Where NEWBURY DOG TRAINER reasonably believes that weather or environmental conditions may compromise safety, welfare or the quality of training, we reserve the right to exercise our professional judgement to:
continue the session as planned;
modify the format or content of the session;
relocate the session to a more suitable environment;
replace the practical session with an indoor or online theory session where appropriate;
shorten the duration of the session;
postpone or reschedule the appointment.
15.6 Decisions regarding adverse weather will be made on a case-by-case basis, taking into account factors including, but not limited to:
ambient temperature;
humidity;
ground conditions;
weather warnings;
travel safety;
the dog's age, breed and physical condition;
the nature of the training being undertaken.
15.7 Where NEWBURY DOG TRAINER determines that a session should proceed, Clients choosing not to attend will be subject to the cancellation policy unless otherwise agreed.
15.8 Where NEWBURY DOG TRAINER postpones or reschedules an appointment due to weather or environmental conditions, Clients will be offered an alternative appointment at no additional cost.
16. Photography and Recording
16.1a From time to time, NEWBURY DOG TRAINER may request permission to take photographs or video recordings for training or marketing purposes.
16.1b NEWBURY DOG TRAINER may also request permission to use any videos, photos, or recordings taken by the Client for marketing and promotional purposes.
16.2 Any photographs, recordings or images created to assist with the delivery of the training programme shall be used for their intended purpose and not shared publicly, unless agreed otherwise. No photographs or recordings will be used for promotional purposes without your prior consent.
16.3 Consent may be withdrawn at any time by contacting NEWBURY DOG TRAINER. Following withdrawal of consent, we will cease using your photographs or recordings for future promotional purposes and will make reasonable efforts to remove them from any websites, social media channels or other platforms that we directly control within a reasonable timeframe.
16.4 The Client acknowledges that it may not be possible to remove photographs or recordings that have already been published in printed materials, shared by third parties, archived by search engines, or otherwise entered the public domain. NEWBURY DOG TRAINER cannot accept responsibility for the continued circulation or availability of such material where it is outside our reasonable control.
16.5 Clients may take photographs or short video clips for their own personal use unless asked not to do so for safety, privacy or welfare reasons.
16.7 Clients may not record or reproduce appointments in full, nor publish recordings for commercial purposes, without the prior written consent of NEWBURY DOG TRAINER.
17. Intellectual Property
17.1 All training materials, written reports, handouts, behaviour plans, videos, digital resources and course content remain the intellectual property of NEWBURY DOG TRAINER unless otherwise stated.
17.2 Materials are provided solely for the personal use of the Client.
17.3 Clients must not copy, reproduce, distribute, sell, publish or use any materials for commercial purposes without prior written permission.
18. Data Protection and Privacy
18.1 NEWBURY DOG TRAINER processes personal information in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and our Privacy Policy.
18.2 Personal information will only be used for purposes connected with providing our services, meeting legal obligations and improving the services we offer.
18.3 Where consent has been given, we may contact Clients regarding future services, educational resources or business updates. Clients may withdraw marketing consent at any time.
18.4 Professional Supervision and Continuing Professional Development
18.5 As part of our commitment to maintaining high professional standards, NEWBURY DOG TRAINER may, with your permission, discuss aspects of your dog's case during professional supervision, mentoring, peer discussion or continuing professional development (CPD) activities.
18.6 Wherever possible, any information shared will be anonymised and presented in a way that does not identify you, your dog or any other individual. The purpose of these discussions is to seek additional professional perspectives, enhance decision-making, troubleshoot complex cases and ensure that the advice and support provided reflects current best practice.
18.7 No identifiable personal information will be shared for these purposes without your knowledge and an appropriate lawful basis under UK data protection legislation.
19. Liability
19.1 NEWBURY DOG TRAINER will provide its services with reasonable care and skill.
19.2 The Client remains legally responsible for the behaviour and control of their dog at all times, including during appointments and classes.
19.3 Except where caused by our negligence or other liability that cannot legally be excluded or limited, NEWBURY DOG TRAINER shall not be liable for:
injury, loss or damage caused by the actions of the Client's dog;
loss arising from inaccurate, incomplete or misleading information supplied by the Client;
loss resulting from the Client choosing not to follow reasonable training, management or welfare recommendations;
indirect or consequential losses, including loss of enjoyment, income or opportunity.
19.4 Nothing in these Terms excludes or limits liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation; or
any liability which cannot legally be excluded or limited.
20. Force Majeure
20.1 NEWBURY DOG TRAINER shall not be responsible for any delay or failure to perform its obligations where this results from circumstances beyond our reasonable control.
20.2 Such circumstances may include, but are not limited to:
severe weather;
flooding;
fire;
road closures;
pandemics;
government restrictions;
power or communication failures;
illness or injury; or
any other event outside our reasonable control.
20.3 Where such circumstances arise, we will make reasonable efforts to rearrange affected appointments as soon as practicable.
21. Complaints
21.1 NEWBURY DOG TRAINER is committed to providing a high standard of service.
21.2 If you are dissatisfied with any aspect of our services, please contact us as soon as reasonably possible so that we have the opportunity to investigate and resolve the matter promptly.
21.3 Complaints should be submitted in writing by email wherever possible.
22. Termination of Services
22.1 NEWBURY DOG TRAINER may suspend or terminate services immediately where we reasonably believe that:
these Terms have been seriously or repeatedly breached;
continuing services would compromise the welfare of a dog;
the safety of any person or animal is at risk;
abusive, threatening or discriminatory behaviour has been directed towards NEWBURY DOG TRAINER or other participants;
the Client deliberately uses training methods that are incompatible with our Positive Reinforcement Policy;
payment remains outstanding after reasonable requests have been made.
22.2 Where services are terminated under this clause due to the Client's actions, refunds for unused appointments will not normally be provided, except where required by law.
22.3 NEWBURY DOG TRAINER may also terminate the Agreement where circumstances arise that make it impossible or inappropriate to continue providing services. In these circumstances, any refund due will be calculated fairly, taking account of the services already provided.
23. Governing Law
23.1 These Terms and Conditions are governed by the laws of England and Wales.
23.2 Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
